D*rby to be relegated?

I just cannot see a penalty being applied to this season; if the EFL attempt to levy one Derby will take them through the Courts, which could result in the start of next season being delayed, and I do not think the EFL would have the stomach for that kind of fight.

I guess Derby will escape this season , but of course if they should get the points deduction this season and don't, there's always a chance that Wycombe and even Sheff Wed could go to the courts. Why should Sheff Wed get a points deduction if another club breaking the same rules doesn't.
 
The guy I spoke with yesterday claimed that the Club and their legal advisors are confident that they will not incur a penalty for changing the way they register amortisation in the accounts.

They have three sets of accounts outstanding; if they are forced to go back to the original method of recording amortisation they will be fucked; that is what they fully expect to happen.

I think the argument will be that the process for penalties is set and everyone signs up to it. Given the organisation of the season it means sometimes a team will be more or less disadvantaged but the process is fair.
 
Confirmation and penalty re Rams to be handed down by EFL today. Unsure of penalty. Likely to be points deduction. Large enough for Mel to appeal, be heard next month and be handed out next season. Guessing at 12 reduced to six on appeal.
 
EFL to confirm they have won their appeal over misconduct charges against #dcfc. Statement imminent. Derby cannot appeal against this decision but can challenge any sanctions that may follow. Any punishment is highly unlikely to be imposed this season
 
An Independent League Arbitration Panel has allowed the EFL’s appeal against the outcome of an independent Disciplinary Commission in respect of misconduct charges brought against Derby County.

The panel concluded that the Disciplinary Commission was wrong to dismiss the League’s expert accountancy evidence, which demonstrated that the Club’s policy regarding the amortisation of player registrations was contrary to standard accounting rules.

More specifically, the panel determined that the Club’s policy was not in accordance with accounting standard FRS102 because it failed to accurately reflect the manner in which the Club takes the benefit of player registrations over the lifetime of a player’s contract.

The original Disciplinary Commission had already concluded that the Club did not adequately disclose in its financial statements the nature and or effect of its change in accounting policy, and there has been no appeal against that decision.

The Club and EFL will now have the opportunity to make submissions on the appropriate sanction arising out of those breaches.

Despite media speculation there is no definitive timescale for a determination on sanction though the League will press for a decision as soon as reasonably possible and will provide a further update at the appropriate time.

The EFL will be making no further comment on this matter at this time.

Keogh being awarded £2.3m in Derby’s situation is going to sting. They can’t even write it off over the length of his contract. Whoever advised Mel over RK issue needs shooting. Along with accountant.

Looks as if the EFL and Derby will be putting forward submissions as to penalty. That could take a while. Makes planning for Derby quite tricky. Can assume penalty is next season and whatever it is Derby will appeal, because that is what they do. Could be sta rt of season before outcome is verified. Makes any sale and rebuild, including loans, quite tricky.

Several clubs, including Derby, had a transfer freeze placed on them until new financial accounts were with EFL. In practice this made little difference but for Derby they could be scrabbling around for new set of accounts recognising the last three years have been completed irregularly. This could have further impacts including convoluted sales process. Remember how transfer restrictions nearly sent us down.

Really is the gift that keeps on giving.

Derby will no doubt appeal Keogh compensation award, but it was a nailed on certainty they'd lose given the treatment Keogh got.

The 2 players who were found guilty of drink driving weren't sacked and neither was the other passenger - presumably because Tom Lawrence & Bennett had a greater value in monetary terms.

"The Player Related Dispute Commission held that Mr Keogh had not committed gross misconduct, that he had not brought the Club into serious disrepute, and that he had been wrongfully dismissed by the Club."

You get the feeling Derby could really be in trouble next season and any buyer will be looking at renegotiating the price....

Their attendance isn’t going to get same the post COVID bounce as everyone else as their fans aren’t going to get any more freebies, the ground issue is going to end in court at some point purely on ownership or fees not just the EFL regulations.

They’ve got to keep Rooney in charge as they can’t afford anyone else (& it’s the only good bit of press they have) & he is never in a million years a good manager

It’s the amount they are appealing now with Keogh I believe.

You can also guarantee they will appeal the number of points they are deducted as well, just to keep the farce rolling a bit longer...

it is a football debt in the contracts column. If they go into administration the administrator will only pay him x amount in the pound though he would be a primary debt and first in the queue.

should we have a tin to collect funds at the first match next season. I have a few spare buttons.
