D*rby to be relegated?

This is quite bad.

Basically, seems the FL hand told the administrators they can't go forward with any bids until the Boro and Wycombe cases are resolved.

But there are no actual legal proceedings started yet.

This was posted as a rumour on their forum

So it seems that the administrators went to the meeting with the EFL yesterday with the expectation that they would leave the meeting being able to name the PB. To do this the EFL stated that DCFC had to fulfil their obligation to show proof of funds and see out the season. Q said we’ll do this via loans until the point at which we name the PB, after which they will put £X of million into the club to see it through to the end of the season – sound plan and one that gives everyone hope / optimism / security. The EFL then said ‘what about the Middlesbrough and Wycombe claims?’ Q answered that ‘legally’ that has no authority and even if it did then they were very confident that they would win the case based on the reality that it has no factual merit and their advice, plus they have followed instruction and rules. The EFL then took the stance that ‘well until this is resolved you cannot name the PB’ which may well be in breach of their own rule book and is certainly a subjective take on how to apply things. Essentially; they are able do what they want and definitely interpret things under the banner of doing so on behalf of their members (excluding Derby obvs). This has caused the latest stand-off and today’s repercussions re. Jagielka
It certainly sounds quite vicious but then apparently the EFL have already told them that the issue needs to be dealt with. Does give you the feeling that the EFL have decided they want something tangible to happen and are therefore turning the screw to ensure Derby are relegated. Worrying when you consider that the EFLs own incompetence has been a factor in the situation developing as it did.

Problem is, how do you resolve a case that hasn't even been brought yet?

Admins can't even begin to resolve a case that is only threatened, especially when some suggestions are that Boro want £45m.

Inevitable that Derby are left scrambling to prove they can finish the season financially in those circumstances

I think they are expecting Quantuma to try talking to Boro and Wycombe rather than just ignoring it. Even if they think it won’t go anywhere there is a conversation that could be had.

It’s a circular argument though. Derby are living off loans and this increasing the debt but the EFL won’t let the sale progress without some movement on this issue so round and round we go.

If you believe Simon Jordan though, the figure of £45m has never been mentioned by Boro.

You would think that the way the EFL have conducted themselves through this whole farce would leave themselves open to legal action.

They obviously think that they can prevent the new owners from taking any action by threatening to with hold the golden share.

If so, they must be hoping that Ashley does not bid for the Club, because he has the funds to go to town on them.

How can you deal with something that has not happened?

The EFL are attempting to rail road the new owners into reaching a settlement before due process has taken place; that is way beyond their remit.

If a new owner takes over prior to a settlement, there will not be one, certainly not in Middlesbrough's case; settling with Wycombe should not cost that much.

It does seem to be a bit extreme doesn’t it? Be interesting to see what the Administrators do. Taking the EFL to Court might be their only option but doesn’t help the club at the moment.

The Sun are running the story that Derby have 17 days to prove funds or lose their golden share. If true, that really is vicious seeing as it’s the EFL blocking progress.

I sort of hope he does. Might sort the useless bastards out.

This required a PB willing to pick up the £5m, not guaranteed or a sale of assets to the tune of £5m. What is new is no PB before the Boro/Wycombe problem is sorted. I agree with Mao, this is extra to normal financial practice and even in EFL terms abnormal by declaring them as football debts. Administrators are in an impossible situation.

With no PB Derby will have to sell assets. Once window is closed Gibson will stop rattling EFL’s cage and a deal can be done. Preferred bidder takes on slightly more debt. Derby relegated with weaker team. Probably start next season with clean financial slate but 15 point deduction.

That is the way I read it as well.
Not sure what the EFL doing is morally correct and it sets a dangerous precedent
