Wheelchair users and gardeners are the target of a confusing and potentially costly European judgment, warn insurance and legal experts
Elderly wheelchair users, gardeners with ride-on lawnmowers and golfers driving motorised caddies may now need to take out car insurance as a 43-year-old European directive has resurfaced.
The obscure rule has been in place for decades but was interpreted to cover all motorised vehicles in a recent court case. Details are still emerging as to how British insurers will adapt.
The Department for Transport is discussing with industry body, the Association of British Insurers, to clarify which types of vehicles will need to be insured and at what level.
Under UK law, "niche" motorised vehicles such as mobility scooters and sit-on lawnmowers do not require the same level of insurance as a car or motorbike.
Lawnmowers, for example, only need cover if they are driven in public places and mobility scooters can drive on roads without insurance.
But European judges have said that the directive from 1972 clashes with these rules and that similar vehicles should have at least third-party car insurance.
