FFP charges?

Because of this wording in our sanction, “Entry point for a significant breach - 3 points.

Not convinced it will have any impact. Apparently it was a 5 point deduction with 3 in mitigation.

Just read though that there are some losses that are in dispute so haven’t been included. Once a decision is made there could be further deductions based on this. Not to mention they are likely to be over the limit again when their next accounts are submitted.

This is such a mess.

The only way I see that this is not going to end in court is if Everton or Forest are either relegated or survive by more than the points that have been deducted.

In Forest’s case I can’t see that happening.

In the Everton one whilst different breaches they are saying it’s mitigated because being smacked twice in same season

Personally I feel it’s 2 breaches so double jeopardy isn’t valid
That is Everton's fault though.
The 1st breach was for 2021-22 but the penalty was delayed because of Everton's silk, and would have seen them relegated if applied correctly.

The important part is as follows:

However, at their hearing, Everton tried to argue that they should not be punished at all, pointing the independent commission in the way of EFL rules on double jeopardy. They state that if a team has already been sanctioned through a breach of PSR, losses in the seasons that have already been assessed should be capped at the threshold, which is £35m per year in the Premier League and £13m per year in the EFL.

If that guideline was followed, and Everton’s losses in the financial years ending in 2021 and 2022 were capped at £35m having been assessed in their first PSR breach, then their over losses would have been reduced by £20m and they would not have breached the threshold in the three-year cycle to 2023. The top flight has no such guidelines, but argued that the EFL rules “could not be directly translated to the economics of the Premier League”.

On that matter, the commission sided with the Premier League saying: “Those (EFL) guidelines are undoubtedly a helpful and compelling benchmark. However, the commission does not consider that they can be transposed directly into the Premier League rules.”

So, exactly how many EFL rules can be transposed directly?

Is there a transparent list of the rules that can be transposed, if so, where the fuck is it?

It looks like there is a pick and mix approach to what rules apply and who they apply them to.

Didn’t they refuse our efl accounts that had been signed off?

Yeah the whole process is unfathomable isn't it as Mao says above it seems like a pick & mix of rules, they pick which ones they want to apply to individual cases in the hope that it will mix everyone up. Surely it's got to be this inconsistency of approach that forms the basis of the appeal, though I have to say that I am still struggling in my own mind to accept that these "Independent commissions" are in any way independent at all

Correct.

So, how do you reconcile that decision with what is quoted there in the second Everton judgement?
THat's why I keep saying the commission should be made up of the same members for each case in any given season, we might just get more consistent interpretations of things then. Some of their interpretations might be consistently wrong but at least they'd have a chance of being consistent.

This double jeopardy rule sucks. Repeat offenders should be more harshly punished
I don't think you actually understand the implications of this.

We are £35m over for 22/23. That means we would need to be £35m under for 23/24 under a 3 year cycle. If we were just on target for 23/24 we would still get punished for the same year of spending putting us over on the 3 year cycle.

In this case we wouldn't be repeat offenders. We would be being punished up to three times for the same year of overspending

Exactly!
I have no problem with the findings and punishment for Everton.
This sets precedent for us next season.
So we keep all our star players and accept that a 2 point deduction is incoming - no problem

has anyone heard anything about our appeal date yet?
I thought the epl had to set the date by 8th April?
