It looks like Marianakis has been granted leave to appeal the original judgement relating to the sale of the club:

Fawaz declared just over 6.5m in liabilities when selling the club, only for the big fella to find that liabilities exceeded 10m.

Fawaz won the original case but since the unfortunate incident regarding the Judge's Garden Shed catching fire, there appears to have been a rethink.

Be interesting to see how things turn out.

As I can't understand either clause 7 or clause 12 I have lost interest in this case, unless of course the £6.5M will go towards transfer/pay kitty.
 
He’s learning from his mistakes, English isn’t his first language, he’s a lifelong fan, more money than sand, this all smacks of an agenda, racists, it’s common practice in the Middle East.

Clause 12 relates to the misrepresentation claim; the Judge made his decision based on the judgment of Lightman J in Inntrepreneur Pub Co v East Crown Ltd [2000].

The appeal Judge thinks otherwise.

Clause 7 relates to Wade versus Roe [1973] and the right to life; Marianakis thinks Fawaz has forfeited his right to life and would like to terminate it as soon as possible.

Former Nottingham Forest owner Fawaz-Al Hasawi suing club over unpaid loans

Former Nottingham Forest owner Fawaz Al-Hasawi is suing the club in the High Court for what he says is around £4.2m of unpaid loans.

It marks the latest in Forest's worsening relationship with their former chairman, who sold the club to Greek shipping magnate Evangelos Marinakis in May 2017.

Forest brought a legal case against Al-Hasawi 18 months ago, claiming unpaid money due from the sale.

Al Hasawi counter-sued, and his case will be heard in the High Court on Tuesday. It is thought a decision from the judges is likely next week.

Al-Hasawi purchased Forest in 2012 and oversaw nine different managers in a five-year period at the City Ground.

Forest avoided relegation to League One on goal difference in Al-Hasawi's final season at the club.

This season, they finished ninth, eight points off the play-off places.

Yes. I think it would be a good idea to put Fawaz out of his suffering and euthanise him as humanely as possible at the earliest convenience.
 
The Club confirms that it has been engaged in litigation with Fawaz Al-Hasawi in order to resolve a dispute regarding the proper treatment of various payments and liabilities under the contractual documentation relating to the sale of the Club in May 2017. The dispute relates to detailed accounting evidence and the interpretation of the Share Purchase Agreement. The Club may seek further clarification of the position on appeal based on independent advice. The Club confirms that this litigation has no bearing on the long term position of the Club or its ability to operate.
