Clubs have until the 4th Thursday in March to enter admin, and the 9 points deduction applied in the same season.
As this has passed, the deduction only applies this season if they stay up. If not, the 9 points applies next season.
Looking at their accounts they have little choice. They are in big trouble.

Is this from Kieran Maguire? He doesn't really say that if you read the thread. Where are you getting this from?

They are in huge debt, points deduction looks certain. This along with 777 looking unlikely to be approved.

I absolutely don't want them hit with double jeopardy on spending they've already been punished for, because then we will as well. But it's pretty clear they are miles over for now as well
 
Do feel sorry for the fans - like us this isn’t their doing and the people responsible should be punished really.

If this saves Luton then it’s really a sad day in football and shame on the EPL.

It’s not really double jeopardy is it? Their 1st charge should have been dealt with last season but the rules at that time meant it was too late. Having said that I’m still dead set against points being taken off as I believe the punishment’s for all the breached teams should be transfer embargoes which forces team to claw back deficits

It's not double jeopardy. They (fortunately for them) suffered no points deduction last season, which would have relegated them, but have breached the rules in two separate seasons, so have committed two separate crimes. That ought to be seen as more serious, not less.

There is a paragraph in the Accounts and audit report which refers to a material uncertainty over club’s ability to trade as a going concern. As Maguire points out "this is not the same as saying administration is probable."

It looks like Everton engaging in emotional blackmail and are pointing out to the IC that a points deduction will tip them over the edge, and will probably frighten off the investment - 777 are clearly waiting to see what happens.

Double jeopardy would be being punished for a breach twice (or thrice) in a three year cycle when the same single season is the cause of the breach.

There is the potential for that happening to us with 22/23; we have already been punished for the spending in that season, which caused us to breach our three year limits. We may well be punished for that season again next year if that same season causes us to breach in the next 3 year period. That would be unfair.

However, if the £35m single season targets are smashed in subsequent years as well (as we NOW know has happened at Everton and, unfortunately, may be the case with us) then a second penalty would of course be fair

I see. It was the scenario in your last paragraph that I had in mind, and I think we agree on that. Scousers don't though.
 
Those accounts pretty much cement a six point penalty based on the logic used on previous ICs. The fact that they lost more money will be seen as an ‘aggravated’ breach in that they are getting worse not better.

Scousers are all either in denial or throwing out the sob stories in hopes of avoiding a punishment.

As an aside a former director is suggesting that if either club goes down as a result of the points deduction then that clubs players could sue if it costs them wages… 🤔
